General Terms and Conditions of Sparkle Paradise (Sprankelparadijs), a trade name of TBP Coaching, established in Delft

1.1 These general terms and conditions apply to all services and products of Sparkle Paradise. The conditions are accessible to everyone and included on the internet site of Sparkle Paradise, established in Delft.
1.2 By transferring a payment for a service or product, you indicate that you agree with the delivery and payment conditions. Sparkle Paradise reserves the right to change its delivery and / or payment conditions after the expiry of the term.
1.3 Unless otherwise agreed in writing, the general or specific conditions or stipulations of third parties are not recognized by Sparkle Paradise.
1.4 Sparkle Paradise guarantees that the service or the delivered product meets the agreement and meets the specifications stated in the offer.
2.1 Prices will not be increased within the term of the offer, unless statutory measures make this necessary or if an intermediary increases it’s price.
2.2 All prices on the site are subject to typing errors. No liability is accepted for the consequences of typing errors.
2.3 All prices on the site are in Euros and include VAT, unless stated otherwise (21% for services, 6% for goods).
3.1 Offers from Sparkle Paradise are valid for 30 days. The conditions can then be adjusted.
4. Payment & Absence
4.1 Services and products by Sparkle Paradise must be paid in advance.
4.2 For services that are delivered on an invoice basis, a payment term of 7 or 14 days applies.
4.3 If the client fails to pay within the stipulated time, Sparkle Paradise has the right to ensure that the client can no longer make use of its services. Even if the client may no longer be able to make use of the service, in any case it will still have to comply with the payment obligation of outstanding invoices.
4.4 When the client has met all obligations, they will be able to make use of all the services of the Sparkle Paradise in the event of a good relationship.
5. Delivery & Return
5.1 Delivery of online services and products takes place immediately. If technical problems are encountered, the client must inform Sparkle Paradise about this and Sparkle Paradise will ensure as quickly as possible that the delivery will still take place according to the agreement.
5.2 Online services and downloadable products can not be returned and no refund is granted, as long as Sparkle Paradise complies with the specifications stated in the offer.
6. Intellectual property
6.1 All services and products that are offered by any of the Sparkle Team Members via Sparkle Paradise fall under their intellectual property. The customer may only use this information for the purpose for which it was provided to the customer, not multiply it and not change or remove the copyright, trademark, design, trade name and other indications.
6.2 Sparkle Paradise reserves the right to use the knowledge gained during the execution of the work for other purposes, in so far no confidential information is communicated to third parties.
7. Privacy & Secrecy
7.1 Personal information and information obtained about the client will not be shared with third parties by Sparkle Paradise, unless the client has given permission in writing.
7.2 Participants in the services of Sparkle Paradise declare through their participation also confidentiality with regard to all information they obtain about any of the Sparkle Team Members and other participants. This information is confidential and must also be treated as such to ensure a safe environment.
8. Cancellation & Cancellation
8.1 Sparkle Paradise has the right to cancel the service without giving any reason or to refuse participation of a client or to refuse the person designated by the client, in which cases the client is entitled to reimbursement of the entire amount paid to Sparkle Paradise with deduction of the services delivered until the termination.
8.2 A Sparkle Service without overnight stay can be canceled or moved free of charge up to 48 hours before the start of the appointment. In case of cancellation or transfer within 48 hours, Sparkle Paradise is entitled to charge the full rate agreed for the service. Failed appointments will be fully charged. If the client is not present at or leaves after commencement, no refund of the paid amount is possible.
8.3 In the event of cancellation of a Sparkle Service with overnight accommodation, such as a Sparkle Week, no refund will be given. The participation may be moved by the client to another week which takes place within 6 months after the written cancellation and informing of Sparkle Paradise. It is also possible to transfer the participation to someone else and to arrange this between yourselves, on condition that Sparkle Paradise is informed in time.
8.4 Any form of membership within Sparkle Paradise can be canceled independently at any time. No reimbursement will be made of the amounts that have already been paid. The cancellation applies to the next collection amount.
9.1 Clients are fully responsible for their personal health and well-being. Services and products from Sparkle Paradise are meant purely to support personal development and should be used in this way.
9.2 Any liability of Sparkle Paradise for personal damage, business damage or other indirect damage or consequential damage, of whatever nature, is explicitly excluded.
10. Change of conditions
These terms and conditions can be changed by means of a simple notices from Sparkle Paradise to the client. In the absence of a protest within 30 days of notification, the amended conditions apply from the date of the notification to all new agreements as well as to all outstanding agreements insofar as they are executed after the day of the announcement.
